1. Who We Are
Pitch (operating as "PitchSMS") is a paid SMS messaging platform that connects fans with creators through dedicated forwarding numbers. The platform is owned and operated by Pitch Labs LLC, a Florida limited liability company ("Pitch Labs," "Pitch," "we," "us," or "our"). This Privacy Policy explains what information we collect from you when you use pitchsms.com or our SMS messaging services, how we use it, and the rights you have over it.
By using Pitch, you agree to the collection and use of information described in this Policy. If you do not agree, please do not use the Platform.
2. Information We Collect
2.1 Information You Provide
- Account information: Your full name, email address, password, and account role (fan or creator).
- Mobile phone number: Required for SMS verification at signup and used for routing paid messages between fans and creators.
- Profile information (creators): Display name, handle, profile photo, bio, and per-message rate.
- Payment information: Payment card details are collected directly by our payment processor, Stripe. We do not store full card numbers on our servers — only a tokenized reference.
- Payout information (creators): Bank account or payout method details required to disburse earnings, processed through Stripe Connect.
- Tax information (creators): Once a creator earns $600 or more in a calendar year, we collect IRS Form W-9 information as required by U.S. tax law.
- Communications: SMS messages exchanged through the Platform, support inquiries, and any other content you submit.
2.2 Information Collected Automatically
- Device & technical data: Browser type, IP address, operating system, device identifiers, and timestamps.
- Usage data: Login activity, pages viewed, messages sent and received, payment transactions, and feature usage.
- Cookies & local storage: Used to keep you signed in, remember preferences, and analyze platform usage.
2.3 Information from Third Parties
- Twilio: Message delivery status, carrier information, and routing metadata.
- Stripe: Payment confirmations, transaction IDs, fraud-risk signals, and payout status.
- Firebase / Google: Authentication metadata when you sign in via Google.
3. SMS Messaging & Consent
Phone numbers are never shared between fans and creators. All messaging is routed through Twilio's infrastructure using dedicated forwarding numbers assigned to each creator. Your real phone number is used solely for:
- Verifying your identity at signup via a one-time SMS code
- Sending account-security alerts (such as suspicious-login warnings)
- For fans only: delivering the reply text message from any creator the fan has chosen to text through Pitch (the fan must initiate the conversation; the creator can only reply)
- Sending support responses if you contact us
Pitch does not auto-text billing receipts after every paid message, send creator payout SMS, or send marketing/promotional SMS. Receipts, message history, creator earnings, and payout details all live inside the Pitch app at pitchsms.com.
We do not sell, rent, or share your phone number or SMS opt-in data with any third party for their marketing purposes. SMS opt-in consent and phone numbers are not shared with affiliates or for promotional purposes by other companies.
4. How We Use Your Information
We use the information we collect to:
- Operate, maintain, and improve the Pitch platform
- Verify your identity and prevent fraudulent or duplicate accounts
- Process payments and disburse creator payouts
- Route paid messages between fans and creators via Twilio
- Send transactional SMS and email notifications related to your account
- Respond to support inquiries and enforce our Terms of Service
- Comply with legal obligations including tax reporting (e.g. IRS Form 1099-NEC for creators earning $600+)
- Detect, investigate, and prevent abuse, fraud, harassment, or violations of our policies
5. How We Share Your Information
We share information only with the following categories of recipients, and only as needed for the purposes described:
5.1 Service Providers
- Twilio — for SMS message delivery, phone-number provisioning, and A2P 10DLC compliance
- Stripe — for payment processing, payouts via Stripe Connect, and fraud prevention
- Firebase / Google Cloud — for authentication, database storage, and hosting infrastructure
- Vercel — for website hosting
These providers are contractually required to protect your information and may only use it to provide services to Pitch.
5.2 Legal & Safety
We may disclose information when we believe in good faith it is required to comply with a legal obligation, court order, or lawful government request; to enforce our Terms of Service; to protect the rights, property, or safety of Pitch, our users, or the public; or to investigate fraud or abuse.
5.3 Business Transfers
If Pitch is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email or in-app notice before your information becomes subject to a different privacy policy.
5.4 What We Do Not Do
We do not sell your personal information. We do not share your phone number, SMS opt-in status, or message content with advertisers or with third parties for their own marketing purposes.
6. Data Retention
We retain your account information for as long as your account is active and for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce agreements. Message content may be retained to support fraud investigation, abuse review, and tax/payment auditing. You may request deletion of your account at any time by emailing pitchsms@gmail.com.
7. Security
We use industry-standard security measures including TLS encryption in transit, encryption at rest for sensitive fields, and access controls limiting employee access to user data. Payments are processed by Stripe, which is PCI-DSS Level 1 certified. While no system is perfectly secure, we work continuously to protect your information against unauthorized access, disclosure, or misuse.
8. Your Rights
8.1 General Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information
- Object to or restrict certain processing
- Withdraw your SMS consent at any time by replying STOP to any Pitch message
- Receive a portable copy of the information you provided

8.2 California Residents (CCPA / CPRA)
California residents have the right to know what categories of personal information we collect, the purposes for which it is used, and the categories of third parties with whom it is shared. California residents also have the right to request deletion and to opt out of the "sale" or "sharing" of personal information. Pitch does not sell personal information.
8.3 European Residents (GDPR)
If you are in the European Economic Area or the United Kingdom, the legal bases for processing your personal information include performance of our contract with you (providing the Pitch service), your consent (for SMS marketing), our legitimate interests (security, fraud prevention, platform improvement), and compliance with legal obligations.
9. Children's Privacy
Pitch is intended only for users who are at least 18 years old. We do not knowingly collect information from children under 18. 10. International Users
Pitch is operated from the United States. If you access the Platform from outside the U.S., your information will be transferred to and processed in the U.S., where data protection laws may differ from those in your jurisdiction.
11. Cookies & Tracking
We use first-party cookies and browser local storage to keep you signed in and to remember your preferences. We do not currently use third-party advertising or cross-site tracking cookies. You can disable cookies in your browser settings, though some features of Pitch may not function properly without them.
12. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. The "Last updated" date at the top of this page indicates when the Policy was last revised. We will notify users of material changes via email or in-app notice. Continued use of Pitch after a change indicates acceptance of the revised Policy.
