1. Acceptance of Terms
By creating an account or using Pitch ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These Terms apply to all users including fans, creators, and any visitors. If you are using Pitch on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. What Pitch Is
Pitch (also referred to as "PitchSMS") is a paid SMS platform that connects fans with creators through dedicated forwarding numbers provisioned through Twilio. Fans pay per message to text creators. Creators receive those messages inside the Pitch app on a private forwarding number and keep 70% of every message fee. Creators may only reply to fans who have texted them first; creators cannot initiate outbound texts to fans. Neither party's real phone number is ever exposed to the other. Pitch is owned and operated by Pitch Labs LLC, a Florida limited liability company ("Pitch Labs," "Pitch," "we," "us," or "our").
3. SMS Messaging Program
Fans receive: a one-time verification code at signup, account-security alerts (rare), and the reply text message from any creator they have chosen to text through the Pitch platform. Pitch does not send fans automated billing receipts after every paid message — receipts and message history live inside the Pitch app at pitchsms.com.
Creators receive: a one-time verification code at signup and account-security alerts (rare). Inbound paid messages from fans, payout details, and earnings live inside the Pitch app, not in SMS. Creators may only reply to fans who have texted them first through Pitch; creators cannot initiate outbound SMS to fans through the platform.
Message frequency depends on your activity. Message and data rates may apply. Pitch does not send marketing or promotional SMS through this number.

Cancel: Reply STOP to any Pitch message at any time to opt out of further SMS. After replying STOP, you will receive one final confirmation message and no further SMS will be sent. Note that opting out of SMS will prevent you from being able to send or receive paid messages on Pitch and may limit your ability to use the Platform.
Carriers: Pitch is supported on major U.S. mobile carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, and others. Carriers are not liable for delayed or undelivered messages.
Privacy: Your phone number and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
4. Eligibility
You must be at least 18 years old to use Pitch. By creating an account you represent that you are 18 or older and that all information you provide is accurate, current, and complete. Pitch reserves the right to terminate any account found to belong to a person under 18.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at pitchsms@gmail.com if you suspect unauthorized access. Pitch is not liable for any loss resulting from unauthorized use of your account.
6. Fan Terms
6.1 Payment
By adding a payment method, you authorize Pitch (through Stripe) to charge your card automatically each time you send a message to a creator. The per-message rate is set by the creator and displayed before you text. All charges are final unless otherwise stated in Section 11.
6.2 Phone Verification
You are required to verify your mobile number at signup via a one-time SMS code. Your verified number is used to identify you on the Platform and to attribute message charges accurately. You may only register one account per phone number.
6.3 Free Trial Texts
New fans may receive up to 3 free trial messages per creator on creators who have enabled the trial. Trial messages do not count as paid messages for the purposes of refund eligibility.
6.4 Conduct
You agree not to use Pitch to send harassment, threats, spam, solicitations, illegal content, sexually explicit material involving minors, or any content that violates another person's rights or applicable law. Pitch reserves the right to block or restrict any fan account at its sole discretion.
7. Creator Terms
7.1 Subscription
Creators pay $4.99 per month for a dedicated Pitch forwarding number. Your card on file will be charged automatically and monthly thereafter. You may cancel at any time and retain access through the end of your current billing period. Subscription fees are non-refundable.
7.2 Earnings & Revenue Share
Creators keep 70% of every message fee received. Pitch retains 30% to cover the forwarding number, payment processing, A2P 10DLC carrier fees, and platform costs. Earnings are calculated based on messages successfully delivered and charged.
7.3 Reply Window
If a creator does not reply to a paid fan message within 48 hours, the fan may be eligible for a refund of that message's fee, and the creator does not earn the associated revenue share for that message.
7.4 Payouts
Payouts are processed through Stripe Connect. Minimum cashout is $10. You are responsible for providing accurate payout information. Pitch is not responsible for failed payouts due to incorrect account details provided by you.
7.5 Tax Reporting
Creators who earn $600 or more in a calendar year will be required to provide IRS Form W-9 information. Pitch will issue Form 1099-NEC for U.S. creators meeting the threshold, in accordance with applicable tax law.
7.6 Phone Verification
Creators must verify their private phone number at signup. This number is never shared with fans. It is used solely to route incoming messages to the creator and for account security.
7.7 Conduct
Creators may not use their Pitch number to solicit, deceive, defraud, or exploit fans. Creators are responsible for the content of their replies. Pitch is not responsible for the content exchanged between creators and fans.
8. Prohibited Uses
You agree not to use Pitch for any of the following, and any use of Pitch for these purposes may result in immediate termination:
- Harassment, abuse, threats, or intimidation of any person
- Fraudulent, deceptive, or misleading activity
- Spam or unsolicited bulk messaging
- Distribution of illegal content, including content that exploits minors
- Distribution of content related to S.H.A.F.T. categories (Sex, Hate, Alcohol, Firearms, Tobacco) in violation of carrier rules
- Promotion of cannabis, CBD, kratom, or any controlled substance to consumers
- Promotion of illegal gambling, payday loans, or high-risk financial products
- Phishing, malware distribution, or any messaging that links to malicious content
- Impersonating another person or entity
- Any activity that violates applicable local, state, national, or international law
- Attempting to reverse engineer, hack, or disrupt the Platform or its infrastructure
- Using the Platform to circumvent or abuse payment systems
- Creating multiple accounts to evade restrictions or bans
- Any activity that violates the Twilio Acceptable Use Policy, the CTIA Messaging Principles & Best Practices, or carrier-specific A2P 10DLC requirements
9. Suspension and Termination
Pitch reserves the right, at its sole discretion, to:
- Suspend or permanently withhold payouts to any creator if Pitch suspects fraudulent activity, abuse of the platform, manipulation of message volume, or any violation of these Terms
- Freeze, reverse, or hold funds associated with any account under investigation
- Terminate or suspend any account — fan or creator — immediately and without notice if Pitch determines that the account has violated these Terms or poses a risk to the Platform, other users, or third parties
- Decline to process any cashout request pending investigation of suspicious activity
Pitch's determination of what constitutes suspicious activity, abuse, or a Terms violation is final. Suspended or terminated accounts are not entitled to outstanding earnings if those earnings were generated through fraudulent or abusive activity. Pitch will make reasonable efforts to notify affected users but is not obligated to do so prior to taking action.
10. Privacy and Phone Numbers
Your real phone number is never shared with other users of the Platform. All messaging is routed through Twilio's infrastructure using dedicated forwarding numbers. By using Pitch you consent to your phone number being used for message routing, billing attribution, identity verification, and platform communications. See our Privacy Policy for full details.
11. Refunds
All message charges are final and non-refundable except in the following cases, determined at Pitch's sole discretion:
- A technical error on Pitch's part resulted in an incorrect charge
- A creator did not reply within 48 hours and the fan requests a refund
- A duplicate charge was processed for a single message
Subscription fees are non-refundable except where required by applicable law.
12. Intellectual Property
All content, design, and code comprising the Pitch platform is the property of Pitch and its licensors. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without express written permission. By submitting content (including profile information and messages), you grant Pitch a non-exclusive, royalty-free license to use, store, transmit, and display that content solely as necessary to operate the Platform.
13. Disclaimers
Pitch is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, message delivery, or that the Platform will be error-free. Pitch is not responsible for the content of messages exchanged between users. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of Liability
To the maximum extent permitted by law, Pitch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid to Pitch in the 30 days preceding the claim.
15. Indemnification
You agree to indemnify and hold Pitch harmless from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising out of your use of the Platform, your content, your violation of these Terms, or your violation of any third-party right.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.
17. Changes to These Terms
Pitch reserves the right to update these Terms at any time. We will notify users of material changes via email or in-app notice. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
